These terms are an agreement between you and TobyTool ("we", "us"). They cover the tobytool.com website and the TobyTool app. By creating an account or using TobyTool you agree to them. If you do not agree, do not use TobyTool.
1. What TobyTool is
TobyTool reads scans of trading cards, matches them against a catalog file you upload, and builds files you can review and use to list cards for sale. TobyTool is a beta preview: features may change, break, pause, or go away without notice while we build it.
2. Your account
You need an account to use the app, and you must be at least 18 years old to have one. Give us a real email address so we can reach you about your batches and your account. Keep your password private: anything done through your account counts as done by you.
3. Price and billing
TobyTool is free to use during the beta: there is no charge, no card is collected, and no subscription is started. After the beta, TobyTool will be a paid subscription, planned at $6.95 per month, one plan for everyone, with no cap on how much you scan and read (reads can be briefly rate limited during times of high traffic).
When the free beta ends we will say so in the app and by email, and every beta account gets at least 30 days of notice before a subscription is needed. If you choose not to subscribe then, you can still see and download your own files. Subscriptions, when they open, will be handled by Stripe: the payment page and the billing portal are Stripe's, and your card number goes to Stripe, never to us.
Prices may change as TobyTool grows. If the price changes, we will tell you before you are charged a new amount. Nothing will ever be charged that you did not knowingly sign up for.
4. Your files stay yours
The scans, catalog exports, order files, and other content you upload belong to you, and so do the files TobyTool builds from them. You give us permission to store and process your files, but only to run TobyTool for you: reading your cards, building your files, showing you your own data, and emailing you when work finishes. We do not sell your content and we do not use it to build anything for anyone else. You promise that your uploads are yours to upload and do not break any law or anyone else's rights.
5. Check your listings: they are your responsibility
TobyTool reads cards automatically, and automatic reading can be wrong. That is why the app flags what it is not sure of, and why this section is blunt: review every card, price, quantity, and file yourself before you list, sell, or ship anything. You are responsible for your listings, your prices, your sales, your shipments, and your compliance with the rules of any marketplace you sell on, including TCGplayer. TobyTool is a helper, not a substitute for your own judgment.
6. Fair use of the beta
Do not misuse TobyTool. That includes: trying to reach other people's accounts or files; probing, overloading, or attacking the service; uploading anything illegal or malicious; reselling or renting access; and using TobyTool for anything unlawful. We may set reasonable limits on use to keep the service healthy for everyone, and we may suspend or close accounts that break these terms.
7. Other companies' services
TobyTool works with files from marketplaces such as TCGplayer, and email reaches you through providers such as Gmail. Those services have their own terms and privacy policies, and we do not control them. TobyTool is an independent tool: it is not affiliated with, endorsed by, or sponsored by TCGplayer, The Pokemon Company International, Nintendo, Creatures Inc., GAME FREAK inc., or Riot Games. Card names, set names, and card images belong to their respective owners and appear in TobyTool only to identify cards.
8. What is ours
The TobyTool software, name, logo, and site design belong to us. These terms let you use the service; they do not give you any other rights to it.
9. Ending things
You can stop using TobyTool at any time. Email us at [email protected] and we will delete your account and your uploaded files. We can suspend or close accounts that break these terms, and we can pause or end the beta itself. If we end it, we will make reasonable efforts to give you a chance to download your files first.
10. No warranty
TobyTool is provided as is, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, and uninterrupted service. Card reading, matching, and pricing can contain errors, and the service can be unavailable.
11. Limits on our liability
To the fullest extent the law allows: we are not liable for lost profits, lost data, lost sales, or any indirect, incidental, special, or consequential damages arising from your use of TobyTool; and our total liability for all claims together is capped at the greater of fifty US dollars or the amount you paid us in the twelve months before the claim arose. Some places do not allow some of these limits, so parts of this section may not apply to you.
12. Changes to these terms
We may update these terms as TobyTool grows. The date at the top always shows the current version. If a change is significant, we will announce it by email or with a notice in the app before it takes effect. Using TobyTool after a change takes effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules. Disputes will be handled in the state or federal courts located in Georgia.
